INTERNAL RULES

The rules of procedure of the Association Renaissance Marocains du Monde are to be brought closer to the history and the Goals of the association (hereinafter referred to as RMDM), which have evolved, from the first weeks of its gestation, its initial objectives towards more extensive, vast, universal and touching on more causes, as needs are identified.

Article 1: Approval of new members:

Any new member must be sponsored and introduced by a member of the association prior to their approval.

He can also subscribe by his own request, analyzed in Sweden at the headquarters of the Association or by the spokesperson and coordinator of the latter.

In any case, it is approved by the membership committee deciding by a majority of all its members.

As an exception for the start-up period of the Association, the payment of its subscription will prove to the member that it is a member of the association.

He will be given at short notice, i.e. before the end of the first fiscal year, therefore before the first ordinary general meeting, the possibility of reading the rules of procedure of the Association by Internet, just as much as he will have to adhere to the charter of operation of the Association, which will define the attitudes to be respected as well as certain mandatory provisions in law, such as the prohibition of calls for public savings or even financial canvassing.

All of this will comply very exactly with the laws governing the Swedish civil code, this choice being explained in “The aims and history of the Association”, of which it will use the terms.

The council decides at each of its meetings on the applications for admission submitted.

People wishing to join will have to fill in a membership form in the short future, less than a year, which will be accessible to them on the Internet, as well as the charter as well as the successful events in aid of the greatest number.

Article 2: Resignation, Expulsion or Death of a Member:

1. The resignation must be sent to the Chairman of the Board by registered letter. It does not have to be motivated by the resigning member.
2. The exclusion of a member can be pronounced by the board, for serious reason.
3. The following are in particular deemed to constitute serious grounds:
– non-participation in the activities of the association;
– a criminal conviction for a felony and/or misdemeanor;
– any action likely to harm, directly or indirectly, the activities of the association or its reputation (cf. charter of the Association).

As the law requires adversarial proceedings, the person concerned must be given the opportunity to present his defense following an exclusion decision.

The exclusion decision is adopted by the board validly constituted for this purpose and ruling by a majority of the members present.

4. In the event of the death of a member, the heirs or legatees cannot claim any maintenance in the association.
The contribution paid to the association is definitively acquired, even in the event of resignation, exclusion, or death of a member during the year.

Article 3: General Meetings and Voting Procedures:

1. Voting of members present:
Members present vote by show of hands. However, a secret ballot may be requested by the council.

Resolutions are adopted after a vote validated by at least 25% of voters including blank votes.

2. Proxy votes:
If a member of the association cannot personally attend a meeting, he may be represented by an agent by original proxy linked to his own identity document and that of his agent.

As provided by Swedish law, as well as almost all laws in the majority of countries where the Association intends to develop, knowing that it was created on March 07, 2022, the next ordinary general meeting will be convened at the closing of the accounts for the year 2023, therefore during the month of June 2024.

The purpose of the annual general meeting is to approve the accounts of the association. The law of 1901 does not oblige an association to meet at a general meeting every year, unless the statutes of the association provide for it.

As a result, as in the best possible organization, regardless of the nature of its activity which could diversify, an association has every interest in scheduling an annual general meeting.

Consequently, this is what the Association Renaissance Marocains du Monde will do, from the first general meeting held.

Article 4: Reimbursement indemnities:

Only administrators and elected members of the office can claim reimbursement of expenses incurred in the course of their duties and on their duly provided supporting documents. However, the latter have the possibility of abandoning these refunds and donating them to the association with a view to the tax reduction according to the articles of the CGI or the equivalent system specific to the tax residence of each donor, if he is attached to a delegation duly registered as linked to the parent Association in Sweden but in another country.

Article 5: Working Committees:

Working committees may be set up by decision of the Board of Directors.

Article 6: Modification of the rules of procedure:

These rules of procedure may be modified by the council or by the Ordinary General Assembly by a vote in favor of it by two thirds of the members present.

Article 7: The charter:

Given its desire to develop throughout the world and for the benefit of all, without distinction of race or religion, for the prior benefit of the weakest and most deprived, the RMDM Association intends to draw up a charter which will be brought to the attention of its members, as defined above.

As soon as possible, it is by Internet that the members (new adherents) will be able and will have then, at the time of their acceptance, to approve the charter of the Association, this one being based on the simple but strict rules binding all the members of all associations subject to the laws that govern the operation of non-profit associations in general.

Article 8: Exclusion of a member of the Association for violation of the internal regulations or the charter of the Association:

The hypothesis of the exclusion of a member for a serious reason having damaged the Association, its image or its good repute, identically having damaged one or more members of the Association, to a partner Association, a subsidiary of the Association in a country in which it will have developed, or to an ongoing charitable action trying to harm it would ideally not see the light of day.

However, this hypothesis cannot be ruled out and behaviors such as those mentioned above could not go unaddressed.

Thus the Board of Directors, meeting for the purpose of judging an attack against the Association or its members (therefore the Management Committee meeting for this purpose) will have to rule on the acts “effective therefore proved” which would be revealed to him, then, according to a vote made by a majority of the votes within the framework of its members responsible for judging it in a committee which can only count an odd number of votes, will have to decide whether or not to exclusion of said member.

Are constitutive of serious faults in particular the attacks by public means with the actions of the Association or with one or more of its members, or in a general way, with the actions being located against the rules stipulated in the charter of the members ( named honorary members for those who have been ratified on their entry).

In particular, any defamatory and harmful remarks made in a public manner against the persons mentioned, as well as against members, whether the latter are natural or legal persons, by one (or by several members gathered in “organized gang” (as provided for in all penal codes in law) will be excluded (or not) according to the vote that will emerge from the body responsible for assessing its scope and nuisance.

Following, a letter sent by registered mail with acknowledgment of receipt will be sent to the possibly excluded member, mentioning the proven facts of which he is accused, and as provided for in the charter and the regulations in their related devices, no refund of contribution will be due. to the member who was expelled.

In fairness, a member who has been expelled may appeal this decision by means of an appeal which he must make known to the headquarters of the Association, in Sweden, by official letter and within 15 days of receipt in his hands of the letter of exclusion which will have justified his/her reason(s).

The appeal thus lodged will be examined by the Association (by its management committee) within one month of its receipt (date of the signature of the acknowledgment of receipt being authentic), given that the meeting of members from different countries requires a date reasonable that would allow it to meet. By way of exception, the said Committee may meet via an Internet meeting on the express condition that all the members meet simultaneously.

At the end of the holding of this meeting placed in review of the exclusion rendered, provided that the said appeal is admissible in its form, as mentioned above, the Association may be required to review the notified exclusion, in whole or in part, or to dismiss the plaintiff’s appeal of all of his claims or of those in greater detail that will be presented later.

It is recalled that in the context of a voluntary exit of a member of the Association, whatever the reason invoked, the contributions paid are not refundable.

In closing, either through Swedish laws or through international laws and treaties, the Association sets out its own right to sue and sue any person(s), member (s) or non-member(s), having engaged in defamatory actions and being harmful to him, before the competent courts, and to possibly assert his right to be paid for damages which may be due to him in compensation for damages suffered.
